1. Agreement
By accessing or using Horyqen AI services, software, APIs, dashboards, or related infrastructure (collectively, the "Services"), you agree to these Terms of Service. If you are entering this agreement on behalf of an organization, you represent that you have authority to bind that organization.
2. Services Description
Horyqen AI provides enterprise cybersecurity infrastructure including autonomous threat detection, cloud defense, anti-fraud intelligence, and security automation. Service scope, deployment models, and feature availability are defined in your executed order form or enterprise agreement.
3. Acceptable Use
You agree not to misuse the Services, including attempts to:
- Probe, scan, or test vulnerabilities of systems without authorization
- Reverse engineer platform components except as permitted by law
- Interfere with telemetry ingestion, incident pipelines, or operational integrity
- Use the Services in violation of applicable export control or sanctions laws
4. Data & Security Responsibilities
You retain ownership of data submitted to the Services. You are responsible for configuring access controls, classifying sensitive data, and ensuring lawful basis for processing. Horyqen implements safeguards described in our Security Policy and Privacy Policy.
5. Service Levels
Enterprise customers receive uptime and support commitments as specified in their service level agreement. Standard evaluation tiers are provided on a best-effort basis unless otherwise contracted.
6. Intellectual Property
Horyqen AI retains all rights to platform software, models, documentation, and branding. You receive a limited, non-exclusive license to use the Services during the subscription term for internal security operations.
7. Limitation of Liability
To the maximum extent permitted by law, Horyqen AI is not liable for indirect, incidental, or consequential damages. Aggregate liability is limited to fees paid in the twelve months preceding the claim, except where prohibited by law.
8. Termination
Either party may terminate for material breach if uncured within thirty days of written notice. Upon termination, access credentials are revoked and data retention follows the Privacy Policy.
9. Governing Law
These Terms are governed by the laws specified in your enterprise agreement, or otherwise by the jurisdiction of Horyqen AI's principal place of business, without regard to conflict-of-law principles.
